Say Goodbye

I know we had this debate back in the fall
but I am still confused. Say Goodbye seems
to have turned in to what started out as
A Quick Lay and Goodbye, or whatever the
name we came up for it was. I was wondering if someone
knew what has happened between these two songs.
Have thay evolved into one song, or is one not played anymore,
or what exactly has happened? any info would be appreciated.

hey. id like to start out by saying this is my first time blush (posting
that is) just a few questions id like to ask.
1)like the guy at rollins, i've heard that DMB will be opening for tom petty
down here in the orlando arena. can anyone confirm this? i couldnt get
tickets for it (taking SAT), so i will have to pay upwards of $60 for a good
ticket. arghhhhhhhhh
2)are there any places on the net that i can get phish info? (any list
servers?????)
3)same question as #2, but Morphine info instead.

his music has lost it's passion
In an interview on NPR Micheal Stripe said that after awhile the emtions
and passion that inspired in him to write songs dissapears and he no longer
enjoys playing them. That is why on their current
tour rem will be playing only material from their last three albums.
Perhaps dave needs to sit down and write some new material. he has been
playing the majority of their songs for long....he can't possiblely feel
the same as when he wrote them..just a thought

Spectrum Dead shows. I already have plane reservations and plans for my spring
break. If some kind minarets member is going to camp out for tickets or can
possibly add on another ticket to your order I would give my first born and dub
tapes for you (I have 900hrs). I need 1 ticket for each night. Sorry for the
waste of bandwidth but this is important to me.
I have no problem at all with someone stealth taping a show. In fact I might
argue that it is our moral imperative to do so. There is a big difference
between stealth taping and "bootleging" in the sense of selling someone elses
music. The decision to not allow taping is often dictated by the music
industry or a bands paranoia, or simply because they suck so bad in concert
they would not want anyone else to hear it. Of course the great bands in
America allow taping :-)
Taping is like taking a "sonic picture" where instead of a still photo you get
a music representation. An audio recording allows you to relive the concert,
and an excellent recording (or a show you've been too) can raise all kinds of
emotion. It may not seem important to you know, but in 30 years these
recordings will be a very important documentation. Imagine taking a camcorder
into the Fillmore East to film the Grateful Dead in 1970, the Allman Brothers
in 1971, and Jimi Hendrix in 1969. None of these bands had offical taping
sections or even had a policy allowing taping. Some of them might have "looked
the other way," but the venue guards had a different objective. I've talked to
people who used to sneak their equipment into the Fillmore East in 1970 to tape
shows (trying to avoid the guards). Those tapers are the messengers from God
if you will. They allow us to experience the music like it really happened.
Would any of you now say these people were wrong for taping the show because
they did not have "permission." I don't think so!
When someone tapes a show they are adding to the history of the group. They
are creating an "audio" history that is very valuable to the present and
future. I cannot tell you how important it is to me to have live recordings of
the Grateful Dead from the early years. "Illegal" Front Of Board (FOB)
audience recordings are the greatest music representations of a concert there
can ever be. They tell us we cannot do it...I think they are foolish and
short-sighted. For many groups like the Grateful Dead the "experience" is
greater than any of the individual musicians combined. It is something that
also exists apart from them, and that that is where the audience and the band
meld to create the magic that keeps everyone going. There is a reason why
people risk loosing their equipment to tape at Dead show or at the Valentines
Dave Matthews show. How many people do you know who would do the same for a
Beach Boys concert?
Consider the future when you make up your mind on this matter. In 50+ years
from now when Dave Matthews, Dead, Phish, etc. are no longer playing it would
be a shame if all that existed were our fading memories. We have a chance to
preserve the memories, experience, music, and the MAGIC. Just think of how
much musical history has already been lost. All of the great artists and
composers who died before audio technology are lost. Most of the work by
Charlie Parker, Miles Davis, and John Coltrane are lost. As I mentioned before
it is our moral imperative to record, preserve, and protect the music of
groups that affect people's lives. Maybe Dave Matthews is not big enough yet
to warrent such strong statements but I believe the Grateful Dead are.

reasons). as far as dates for FJB, the hotline # is 312-525-3980. it
will probably have the latest dates.
but i'm curious to know how you came across this fact. please don't
refer me to any biblical passages because i've read them all at one time
or another. just want to know some reasoning/logic behind your
statement.

Frankle..i forgot to tell you...when you ask to be digestified it
eliminates 30 liitle blurbs of a message however it sends you one long-ass
digest of all the messages put together..in my opinion it's worse but you
can be the judge! J.

I ordered my tickets last weekend for the March 18th show in St. Paul. I was
kinda dissapointed to find out they are removing the seats on the floor for
general admission. Now I have seen Dave at both general admission venues and
also seating venues like at HORDE. I was wondering how everyone out there in
minarets prefers to see a show?

and remember - since we are all the leaders of tomorrow, lets take the rest of

checking... How's about those rarities and Davemaltations tapes?
I'm working on the everything FAQ, and there will be a homepage soon, if not
now, and some other everything stuff....I have some questions for you guys.
First, what sorts of things do you want in the FAQ besides what is in the
general structure of the DMB FAQ? I've got 4 sections, one on the net
whenever it gets started, one on the band and related musicians, equipment
etc, one on the musiic, and sources of merchandise, and a section largely
adapted from the minarets section on taping, with specific stuff pertaining to
everything shows....thanks for the ideas Ellis, I'll note the ideological
contributions in the credits. Anyway, what do you want to see? What questions
can I ask teh band, ask Randy the manager, anything. Email me for your
thoughts, PLEASE! Also, if you know of songs beside those I will list, then
email me and I will include them in the FAQ and lyrics files, and all that.
Last thing,., if you have any shows on tape or any setlists, please email me
and send me the setlist, as I am also developing the "Essence" a sort of
Warehouse-like idea [ Sampler, Helping Phriendly Book, Dead Base] of setlists
and past performance dates. Anyone with info, please mail me [ Scott @ Vtech,
I know you've got some info, and I'll continue to be in touch]....
come up with...okay got a good one, who invented the flush toilet and when is
Bob Marley's Birthday? If you find th answer to both of those, then email me

All,
such level-headedness to the people who have accused Dave of being a
so-called "sellout". This person seems to have a firm grasp of the way the
business world works. yes, so Dave is playing a concert for the big execs
but only for the promotion of the DMB with the hopes of expanding the band's
music and appearance. It's not like this is an everyday thing for Dave. Cut
him some slack. I know I would do the same if I were in his shoes.

Satellite and Ants (Quit blasting them)

every time satellite and ants are on a setlist that if it weren't for those
songs I wouldn't have ever gotton into the dmb several years ago. I really
love these songs. I do realize that they may be overplayed, but if they
hadn't played that at my first concert, I would have been upset. So please
don't boo those songs, they are really awesome. You've just been to too
many concerts.

eek........ this is... well, i guess people do have a right to their own
opinions... this has nothing to do with dave i guess, but i was wondering
how many others out there share this same opinion? new york can sometimes
give me a very isolated, if in my opinion resoundingly correct, view of
issues, i guess in this case specifically pertaining to homophobia. are
there a lot of people out there who think 'being gay is very wrong'? if
you, would you send me some mail just telling me? i don't want to get into
an argument, that would be silly... but it's interesting to me since i
guess i know very little about the south.

random thoughts

To Ben and the rest of us shocked by the homophobia- Welcome to the
nineties and the world of newtology. Just when you thought it was safe
to come out of the closet...
see it as a graphic representation of that feeling deep in your soul as
you groove with DMB. Works for me. Anyone else?
Anyone going to Lafayette know a place to meet or hang there?

2/15 Carpenter Center Review

now that i've come off my initial
SMILINGGRINIJUSTSAWDAVEMATTHEWSBANDINCONCERT high, i can make some
semi-coherent comments about what i experienced yesterday.
after catching a ride with the cool-as-ice Morgan Daily, we arrived at
the 3rd Street Cafe in time to catch a quick dinner with Boofy and the gang.
if you're in Richmond, check this place out, but be prepared to WAIT a
while for your food...
the Carpenter Center is one of the classiest places i've been to in a
while. it certainly was a shock after the Tower Theatre! the crowd
ranged from Fully-Dressed-Up-and-Primpin to
Jeans-and-a-Tee-Shirt-Isn't-My-Hat-Cool. i've never seen such a
diverse crowd. i think the funniest person i saw all night was this guy
with a beer in each hand, singing the words to Lover Lay Down during
intermission. i don't think he even cared that he sounded like my dog
howling at the neighborhood cat... ;)
the orchestra was in back of the band, who walked on looking absolutely
STYLIN. Leroi in all black, Boyd in all gray, Stefan with NO HAT,
Carter in a suit and tie-less white, and Dave. in black, with this
crazy red and yellow tux jacket. kewl. Carter's set was walled in
by plexiglass to keep the orchestra from vibrating his drums, i guess.
Dave and Stefan were sitting down, which made things awkward for the
whole Dave-Carter dynamic...John D'Earth, with his full score, was
cueing Dave when it needed doing. neeto.
the orchestra did this little opening ditty, i don't know why. it
wasn't very memorable. if they really wanted to show off, they
would've done #34 or something (yeah, right, dom, you wish). they
had their moments, but i think overall the arrangements could've been a
little more... spicy.
the setlist was ALMOST the same...
i couldn't believe it, but the orchestra came in about .5 seconds too
late! Dave just shook his head and played on, and after about three
seconds, they were in sync. the rest of the song was impressive, but
only in that it was a new sound. the realization that i was listening
to DMB-plus came at
FAT. HUGE. when the tympany drums BOOMED at Dave's first lyrics
it shook my SOUL! i'll never forget it.
perfect after Granny. nice and scary.
this song was MADE for orchestral accompaniment. John did good.
SO nice. just the band. Dave dedicated it to the orchestra.
all of a sudden, there were people dancing everywhere. i couldn't help
it, but i jumped up and started bopping. you know that one riff that
Leroi ALWAYS plays? the one near the end, just before Carter goes
off? it was like Leroi was playing the pied piper and the orchestra
was a bunch of mice (or ants, as the case may be). every woodwind in
the place was playing that riff, and i just about lost it. damn, he's
good.
bop bop bop
it was like a dark lullaby. all those strings! the orchestra had
some sweet dynamics here.
one of the scariest things i've ever heard. the RSO had this giant,
building, dissonant intro, then the band joined quietly, until Dave gave
the cue to start. [shiver] "Summer rain burns holes in the
flowers. DANGEROUS HOURS."
this was John D'Earth's masterpiece. he had these muted horns doing
Tim's line, just like on UTTAD. the cellos were mimicking Dave, the
basses were backing up Stefan, and the violins were Satellites. whooo.
flawless. just Dave and Carter. only a few drunken shouts...
i didn't think this song was supposed to be chilling, but i guess John
disagrees. all i remember was the whole orchestra backing up Boyd
during "LOOOOK UP AT THE SKY my mouth is open wide..." Boyd was really
hot all night. he had a huge solo and he was JUMPing around stage.
he had the most freedom during this performance, i felt.
(just the band)
ahhh, thank you CARTER! he told me afterwards, "So there I was, in the
middle of my solo, and I thought, 'Damn, I picked the wrong stick for
THIS song...'" he broke one, and just hucked it over his head, like he
was in his basement, jamming or something. the poor violinist whose
head it beaned off of just laughed... Dave said, "It's so nice that we
can all get together, enjoy ourselves, and face the same direction for a
few hours." screw-AY! man, i was SO into this.
i've determined that Carter Beauford is the friendliest man
alive. Stefan was chill, as always. he said his old bass teacher
was sitting 2nd chair, "It felt just like home." :)
well, this post has been WAY too long, so i'll get out of here. i hope
all you minaretters who couldn't make the show have a better taste of
what it was like.
i have to say hi to Boofy (if he's read this far) and Mike and Morgan,
cause they rock. here's to Honey Porter and the Liberty Lunch!

I was the one who most recently asked if Dave was gay. I thought that I might
get some flak for this, but I have been torched, not personally, on the subject
I have a problem with those of you who gave me shit for asking and then answeredmy question. This just tells me that by you knowing the answer, you at one
point took the time to ask of figure out the answer yourself. Just admit it
that you are just as curious as the rest of us, don't give me that "its none
of our business" bullshit. I'm not asking what exactly Dave does in the bedroom
or who with. I believe that in this day and age asking if someone is Gay is
fine. To those of you who stood up for me, thanks. To those of you who tried
to shoot me down for asking a harmless question, FUCK YOU!!!. If Dave is Gay
or Bi-sexual, or straight does not matter to me, he can choose whatever sexual
partner he wants as far as I'm concerned as long as he continues to create
great music.

Does anyone know what time signature #34 was written. I was listening to
an old tape that I have and could hear some distinctive 6/8 patterns; but,
bits and pieces of the song threw me for a loop. I think that it was written

To all,
Thanks for all of the eye-witness accounts of the V-day shows; It
was the next best thing to being there.
Anyway, I was at the beach yesterday (don't be mad, it's kind of a
curse/blessing to live in South Florida) and it was the first time
I had brought a Dave tape to the beach. I was listening to the
VA Horse Center, tape two (great tape) and it was almost euphoric...
the waves crashing, gulls making gull noises, ships on the horizon,
almost no one there and Dave singing CRY FREEDOM in the backround.
Paint me a picture...It never sounded like this in the car.
I realize that I used a semi-colon in this message. I swore I
would never do that in a non- academic paper. Sorry.

originally thought that was what dave was singing. Personally I think it would
be a cool line.

good? They are coming here tomorrow, and I need to know if its worth my time to
go check them out.

i don't know about #34, but i've been working on the intro to one sweet
world and found it equally intricate, meter-wise. i've gotten so i'm
playing it the way it sounds, but i still can't tap my foot to it. i
think maybe it's in 4/4 with a bar of 3/4 one bar before the end that
screws me up every time. anyway, sorry i couldn't help with #34--haven't
gotten it on tape and don't listen to the CD enough. anyone else know of
any other metrical intricacies in any of the songs?

This is my first minarets post though I have been listening in for a
while and I just wanted to agree with wendal, whose post is included
above. Going to school in the south has made me aware, even more so than
before, and trust me being from Greenwich Village NYC makes you aware, of
how prevalent homophobia really is. Personally, I am heterosexual, but
really who gives anyone the right to speak for anyone else? (To get some
DMB content) I mean homosexuality is a choice (or biologically
assured....another issue) just like liking one specific song or another.
I admit #34 is not my favorite song....so please dont try to lynch me for

Yup, I've heard of them and yes, you should go see them!
They just released a new cd and are making the rounds promoting
it. They don't sound like anybody so I can't compare them.
They have lead, rhythm, bass, drums and percussion. Most of
the songs are performed their female lead singer. They are quite
talented and very tight. Don't be afraid to check them out.
It's less expensive than a movie!

I just happen to have in my hot little hands the latest issue of the
Colleg Music Journal, a weekly journal that has album reviews and music
charts for every type of music you could imagine.
Now this may come as bad news to some of you old-school fans of DMB who
seem to loathe the reality that DMB is fastly becoming popular because
they are finally recieving the praise and recognition that they have
deserved for a long time. Or.... this may come as good news to those
fans of us who are glad to see our local heroes get much deserved
According to the CMJ DMB is now in the top 40 of every chart that applies
to them.
CMJ Top 150 has them at #37
CMJ Triple AAA, which is a compilation of radio play from VH1 type
stations has DMB at #3, behind only Tom Petty (1), and Pearl Jam (2).
They are ranked ahead of such notables as REM, Blues Traveler, Eric
Clapton, Liz Phair, Hootie....,Sheryl Crow, Nirvana, Widespread, and yes,
the Eagles!!!
CMJ Retail chart has DMB ranked #34
CMJ Video Chart has DMB at #35 in the top 75 overall and #15 in the
Alternative 40 Video chart
I just thought I'd let you all know how the band was doing in the College
radio scene. For those of you who never wanted to see DMB get big, I

felt I could keep quiet no longer. I just wanted to say to everyone who has
somewhere else. I'm not "taking sides" in the argument, but I really do not
feel that Minarets is the proper forum in which to debate the morality or
immorality of homosexuality. There are plenty of newsgroups out there which
cater to this sort of thing. Hope I didn't offend anyone, but I've been a
Dave Matthews fan pretty much since the band formed (the first performance
I saw was at my "first year picnic" here at UVA) and I'd much rather
discuss the band's music than anyone's sexual orientation.

This is my first post to the net, but I have been lurking around in the
shadows for a while. I feel compelled to respond to what people have been
saying lately.
First, it is pathetic that you are all so concerned about Dave's sex
life. It's his business, so I won't say more.
As for selling out, I can say that growing up in Charlottesville has
allowed me to see the band evolve from almost the beginning Dave's
career, and having paid six dollars all those Tuesdays to see Dave at
Trax, I am glad to see Dave finally pull in some money. True, at $23, I
probably won't many more DMB shows, but I've seen him enough now that I
don't mind so much. More importantly, it's HIS/THE BAND'S life and
music, and they deserve the chance to get fame and fortune and all that
good stuff. I would be disappointed if the music began to suffer, but I
haven't seen any sign of that at all. The only difference I have noticed
in recent concerts is that the band doesn't play for quite as long, and
that the arrangements are getting better, if anything.
I recently heard a UVA student say that now that DMB is popular, she
doesn't like them. Such people were never fans of the music, only the
image, and I am sure that some new obscure band will eventually come
along and make them happy. As for me, I hope MTV keeps playing WWYS and
making money for the DMB.

recently, there's been outbursts of different types on a couple different
nets.
on bt, there's been several random flame baiting posts, with juvenile
pictures.
on dave, there's been talk about sexual preference. (and a dumb faked post
from duke.)
rather than responding to these posts so that the entire net reads "FUCK
YOU's" and "YOU'RE AN ASSHOLE BECAUSE YOU DON'T THINK LIKE ME's", it seems
life would be much simpler AND quieter if, in the case that you feel it
absolutely necessary to respond to someone, you do it through private email.
if you don't want to get into a private debate over what was posted, then
it's real easy to just not hit the 'R' key.
I honestly don't mind a message every now and then from someone who has
nothing better to do than post inflammatory or non-topical messages. it
comes with the territory with newsgroups and mailing lists. (although bt
does get quite a few more) what gets my goat are the many net-posted
responses which are truly hypocritical and often more offensive than the
original post.

they say,"Hey lets write a tune in alternating phrases of 5/8 and 7/8,
and a bridge back in 4, or do they just do it? Do they ever transcribe any
of the music they write? Just curious...

DMB Tapes

have tapes to trade. I have no such tapes, unless you want to count
two very old spin doctors tapes, with which to trade for DMB tapes.

Hey all Minaretters,
If you want a copy of this memorable show this is the time to respond.
To any ultra newbies out there, a tree is simple an organized way of
distrubuting a popular show. I expect that this tree will generate an
emmense number of responses so please use the form use the form below so
I can process all the requests.

experience with Dave and the band as well as Carter's comments after the
show, it seems that the "no taping" was more due to the Symphony and
contractual stuff rather than the bands wishes. I also think that every
DMB fan out there should hear this show, whether they were able to make
it there or not.

Foster posted an offer of the Valentine's Day show. She is an
aquaintence of my brother and assumed that she'd be getting a copy
immediately through my brother. Well, to make a long story short, if
you are supposed to be getting a copy from her please sign up for the
tree instead. I'm trying to get copies out to everybody through this
tree and I appreciate that y'all are willing to put up with the slight
delay that comes with organizing a tree.

This is the last thing that I am going to say about this subject
so listen up. First of all I am not a homophobic and I am not a
bigot. Second I did not start this whole gay thing and in fact I

Christmas Song and Remember 2 Things?

Has anybody figured out the date of the show, Christmas Song was recorded
on. The CD says it was recorded live at Trax with Tim Reynolds. I would be
interested in the date of the show so if anyone has a clue fire 'em out. I
am curious if Tim does any backup vocals, you can here them during the
love, love, love. But back to the date of the show, I wonder if that
night they recorded a buch of songs, maybe as trials for the CD, anyway it
might have been a killer show! Groovy Beans.

sxsw music festival 1995

sorry...only somewhat tangental dmb content here....
just scanned through the list of acts that will be converging
on austin for this year's south-by-southwest music festival..
(i'm not positive about this...but i would have to guess that
sxsw is probably the largest and most influential
live-music events in the country...)
included in the list of over 500 bands from all over the
world is charlottesville's very own ms. shannon worrell!
also blues traveler, chris whitley, jayhawks, jackopierce,
matthew sweet, victoria williams, bob mould, and so many more
i can't even begin to think...
the festival runs in 34 different austin venues from march 16-19...
wristbands that get you in to every show are $35 i think...
if anybody's cancun plans for spring break happen
to fall through...it just might be worth it to
road-trip to austin for this one....!

seeing TR3, an unbelievable group. Well actually the unbelievable part was
the leader Tim Rynolds. He is absolutely incredible. He and the band
jammed for at least 2.5 hours and they were incredible the whole time. If
you havent seen this band, go quickly and see them. I think you will
understand exactly what Im talking about.

This document is an electronic Petition Statement to the
U.S. Congress regarding pending legislation, the
"Communications Decency Act of 1995" (S. 314) which will
have, if passed, very serious negative ramifications for
freedom of expression on Usenet, the Internet, and all
electronic networks. The proposed legislation would remove
guarantees of privacy and free speech on all electronic
networks, including the Internet, and may even effectively
close them down as a medium to exchange ideas and
information.
For an excellent analysis of this Bill by the Center for
Democracy and Technology (CDT), refer to the Appendix
attached at the end of this document. The text to S. 314
is also included in this Appendix.
This document is somewhat long, but the length is necessary
to give you sufficient information to make an informed
decision. Time is of the essence, we are going to turn
this petition and the signatures in on 3/16/95, so if you
are going to sign this please do so ASAP or at least before
midnight Wednesday, March 15, 1995.
Even if you read this petition after the due date, please
submit your signature anyway as we expect Congress to
continue debating these issues in the foreseeable future

In united voice, we sign this petition against passage of S. 314 (the
S. 314 would prohibit not only individual speech that is "obscene, lewd,
lascivious, filthy, or indecent", but would prohibit any provider of
telecommunications service from carrying such traffic, under threat of
stiff penalty. Even aside from the implications for free speech, this
would cause an undue - and unjust - burden upon operators of the various
telecommunications services. In a time when the citizenry and their
lawmakers alike are calling for and passing "no unfunded mandates" laws
to the benefit of the states, it is unfortunate that Congress might seek to
impose unfunded mandates upon businesses that provide the framework for
the information age.
An additional and important consideration is the technical feasibility of
requiring the sort of monitoring this bill would necessitate. The
financial burden in and of itself - in either manpower or technology to
handle such monitoring (if even legal under the Electronic Communications
Privacy Act) - would likely cause many smaller providers to go out of
business, and most larger providers to seriously curtail their services.
The threat of such penalty alone would result in a chilling effect in the
telecommunications service community, not only restricting the types of
speech expressly forbidden by the bill, but creating an environment
contrary to the Constitutional principles of free speech, press, and
assembly - principles which entities such as the Internet embody as
nothing has before.
By comparison, placing the burden for content control upon each individual
user is surprisingly simple in the online and interactive world, and there
is no legitimate reason to shift that burden to providers who carry that
content. Unlike traditional broadcast media, networked media is
comparatively easy to screen on the user end - giving the reader, viewer,
or participant unparalleled control over his or her own information
environment. All without impacting or restricting what any other user
wishes to access. This makes regulation such as that threatened by this
S. 314 simply unnecessary.
In addition, during a period of ever-increasing commercial interest in
arenas such as the Internet, restriction and regulation of content or the
flow of traffic across the various telecommunications services would have
serious negative economic effects. The sort of regulation proposed by this
bill would slow the explosive growth the Internet has seen, giving the
business community reason to doubt the medium's commercial appeal.
We ask that the Senate halt any further progress of this bill. We ask
that the Senate be an example to Congress as a whole, and to the nation
at large - to promote the general welfare as stated in the Preamble to
the Constitution by protecting the free flow of information and ideas
across all of our telecommunications services.

SENATOR EXON INTRODUCES ONLINE INDECENCY LEGISLATION
A. OVERVIEW
Senators Exon (D-NE) and Senator Gorton (R-WA) have
introduced legislation to expand current FCC regulations
on obscene and indecent audiotext to cover *all* content
carried over all forms of electronic communications
networks. If enacted, the "Communications Decency Act of
1995" (S. 314) would place substantial criminal liability
on telecommunications service providers (including
telephone networks, commercial online services, the
Internet, and independent BBS's) if their network is used
in the transmission of any indecent, lewd, threatening or
harassing messages. The legislation is identical to a
proposal offered by Senator Exon last year which failed
along with the Senate Telecommunications reform bill (S.
1822, 103rd Congress, Sections 801 - 804). The text the
proposed statute, with proposed amendment, is appended at
the end of this document.
The bill would compel service providers to chose between
severely restricting the activities of their subscribers
or completely shutting down their email, Internet access,
and conferencing services under the threat of criminal
liability. Moreover, service providers would be forced to
closely monitor every private communication, electronic
mail message, public forum, mailing list, and file archive
carried by or available on their network, a proposition
which poses a substantial threat to the freedom of speech
and privacy rights of all American citizens.
S. 314, if enacted, would represent a tremendous step
backwards on the path to a free and open National
Information Infrastructure. The bill raises fundamental
questions about the ability of government to control
content on communications networks, as well as the locus
of liability for content carried in these new
communications media.
To address this threat to the First Amendment in digital
media, CDT is working to organize a broad coalition of
public interest organizations including the ACLU, People
For the American Way, and Media Access Project, along with
representatives from the telecommunications, online
services, and computer industries to oppose S. 314 and to
explore alternative policy solutions that preserve the
free flow of information and freedom of speech in the
online world. CDT believes that technological
alternatives which allow individual subscribers to control
the content they receive represent a more appropriate
approach to this issue.
B. SUMMARY AND ANALYSIS OF S. 314
S. 314 would expand current law restricting indecency and
harassment on telephone services to all telecommunications
providers and expand criminal liability to *all* content
carried by *all* forms of telecommunications networks.
The bill would amend Section 223 of the Communications Act
(47 U.S.C. 223), which requires carriers to take steps to
prevent minors from gaining access to indecent audiotext
and criminalizes harassment accomplished over interstate
telephone lines. This section, commonly known as the
Helms Amendment (having been championed by Senator Jesse
Helms), has been the subject of extended Constitutional
litigation in recent years.
* CARRIERS LIABLE FOR CONDUCT OF ALL USERS ON THEIR
S. 314 would make telecommunication carriers (including
telephone companies, commercial online services, the
Internet, and BBS's) liable for every message, file, or
other content carried on its network -- including the
private conversations or messages exchanged between two
consenting individuals.
Under S. 314, anyone who "makes, transmits, or otherwise
makes available any comment, request, suggestion,
proposal, image, or other communication" which is
"obscene, lewd, lascivious, filthy, or indecent" using a
"telecommunications device" would be subject to a fine of
$100,000 or two years in prison (Section (2)(a)).
In order to avoid liability under this provision, carriers
would be forced to pre-screen all messages, files, or
other content before transmitting it to the intended
recipient. Carriers would also be forced to prevent or
severely restrict their subscribers from communicating
with individuals and accessing content available on other
networks.
Electronic communications networks do not contain discrete
boundaries. Instead, users of one service can easily
communicate with and access content available on other
networks. Placing the onus, and criminal liability, on
the carrier as opposed to the originator of the content,
would make the carrier legally responsible not only for
the conduct of its own subscribers, but also for content
generated by subscribers of other services.
This regulatory scheme clearly poses serious threats to
the free flow of information throughout the online world
and the free speech and privacy rights of individual
users. Forcing carriers to pre-screen content would not
only be impossible due to the sheer volume of messages, it
would also violate current legal protections.
* CARRIERS REQUIRED TO ACT AS PRIVATE CENSOR OF ALL
S. 314 would also expand current restrictions on access to
indecent telephone audiotext services by minors under the
age of 18 to cover similar content carried by
telecommunications services (such as America Online and
the Internet). (Sec (a)(4)).
As amended by this provision, anyone who, "by means of
telephone or telecommunications device, makes, transmits,
or otherwise makes available (directly or by recording
device) any indecent communication for commercial purposes
which is available to any person under the age of 18 years
of age or to any other person without that person's
consent, regardless of whether the maker of such
communication placed the call or initiated the
communication" would be subject of a fine of $100,000 or
two years in prison.
This would force carries to act as private censors of all
content available in public forums or file archives on
their networks. Moreover, because there is no clear
definition of indecency, carriers would have to restrict
access to any content that could be possibly construed as
indecent or obscene under the broadest interpretation of
the term. Public forums, discussion lists, file archives,
and content available for commercial purposes would have
to be meticulously screened and censored in order to avoid
potential liability for the carrier.
Such a scenario would severely limit the diversity of
content available on online networks, and limit the
editorial freedom of independent forum operators.
ADDITIONAL NOTABLE PROVISIONS
* AMENDMENT TO ECPA
Section (6) of the bill would amend the Electronic
Communications Privacy Act (18 USC 2511) to prevent the
unauthorized interception and disclosure of "digital
communications" (Sec. 6). However, because the term
"digital communication" is not defined and 18 USC 2511
currently prevents unauthorized interception and
disclosure of "electronic communications" (which includes
electronic mail and other forms of communications in
digital form), the effect of this provision has no clear
importance.
* CABLE OPERATORS MAY REFUSE INDECENT PUBLIC ACCESS
Finally, section (8) would amend sections 611 and 612 of
the Communications Act (47 USC 611 - 612) to allow any
cable operator to refuse to carry any public access or
leased access programming which contains "obscenity,
indecency, or nudity".
Government regulation of content in the mass media has
always been considered essential to protect children from
access to sexually-explicit material, and to prevent
unwitting listeners/views from being exposed to material
that might be considered extremely distasteful. The
choice to protect children has historically been made at
the expense of the First Amendment ban on government
censorship. As Congress moves to regulate new interactive
media, it is essential that it understand that interactive
media is different than mass media. The power and
flexibility of interactive media offers a unique
opportunity to enable parents to control what content
their kids have access to, and leave the flow of
information free for those adults who want it. Government
control regulation is simply not needed to achieve the
desired purpose.
Most interactive technology, such as Internet browsers and
the software used to access online services such as
America Online and Compuserve, already has the capability
to limit access to certain types of services and selected
information. Moreover, the electronic program guides
being developed for interactive cable TV networks also
provide users the capability to screen out certain
channels or ever certain types of programming. Moreover,
in the online world, most content (with the exception of
private communications initiated by consenting
individuals) is transmitted by request. In other words,
users must seek out the content they receive, whether it
is by joining a discussion or accessing a file archive.
By its nature, this technology provides ample control at
the user level. Carriers (such as commercial online
services, Internet service providers) in most cases act
only as "carriers" of electronic transmissions initiated
by individual subscribers.
CDT believes that the First Amendment will be better
served by giving parents and other users the tools to
select which information they (and their children) should
have access to. In the case of criminal content the
originator of the content, not the carriers, should be
responsible for their crimes. And, users (especially
parents) should be empowered to determine what information
they and their children have access to. If all carriers
of electronic communications are forced restrict content
in order to avoid criminal liability proposed by S. 314,
the First Amendment would be threatened and the usefulness
of digital media for communications and information
dissemination would be drastically limited.
D. NEXT STEPS
The bill has been introduced and will next move to the
Senate Commerce Committee, although no Committee action
has been scheduled. Last year, a similar proposal by
Senator Exon was approved by the Senate Commerce committee
as an amendment to the Senate Telecommunications Bill (S.
1822, which died at the end of the 103rd Congress). CDT
will be working with a wide range of other interest groups
to assure that Congress does not restrict the free flow of
information in interactive media.

Hey guys. I have a little dilemma. I dont have any DMB shows on tape.
I know theres gotta be a few good people out there that will make tapes
for me. I can either send blanks and postage or if you want to trade a

DAVE MATTHEWS BAND - Live on MTVO Wed nite 2/22 at 8pm et!
Few bands have pulled off building the huge fanbase that Dave Matthews Band
did without major TV or radioplay. By the time of the release of their
major label debut, "UNDER THE TABLE AND DREAMING," anticipation had built
to such a fevered pitch that their headline show at New York City's
Roseland Ballroom sold out in just three days!
Dave Matthews himself is a South African expatriate who settled in
Charlottesville, Virginia as a teenager. The band consists of some of the
most respected musicians of the local Charlottesville scene. Together they
make jazzy, folk-inspired rock with an array of multicultural influences.
Dave Matthews band will be live on MTVO Wed. night 2/22 at 8pm est in the
MTV Arena (Odeon). And catch the video for their single, "What Would You
Say," on MTV.

I met the man himself...

I know it's all been said already, but I would like to share with you what
happened to me and my friends on the 15th. I am writing it now, because I am
finally waking up after the longest trip of my life. We came a long way, and
were far from being disappointed. See, we met the band, thanks to Carter who
hooked us up with backstage passes. We met him at a show in Albany NY and he
happened to see a necklace that I was wearing. It was a necklace of the Fire
Dancer that somone made for me. He thought it was the greatest, so I asked
him if he wanted one and he graciously accepted and said that he would meet
up with us in VA. Well, I made a necklace for him and one for everyone else
in the band, and they loved them. Dave was really pleased and totally
surprised by it. He said that he was thinking of an idea just like that. He
said I guess you beat me to the punch though, so it looks like you will have
to get some type of credit for it. He was so nice to us. We talked with
everyone for awhile and before we left Dave grabbed my arm and asked me to
give him my name once again. He wrote it down on the back of the necklace and
said this was so he never would forget. I think that was one of the nicest
things he could of done. It shows that he really does appreciate his fans,
and I'll never forget that. If anyone is going to go see Dave in the near
future, he said that he was going to wear the necklace all the time, so look
for it. And if you remember, let me know if you see it. I would appreciate
it. Thanks for listening...
And thanks to the ones who made the trip with me, I don't think I would have
made it with out you. Leaving at 11:30 at night and getting pulled over by a
hick cop and Mario Andretti driving through the storm, and Bruin, well enough
said.
I know I am rambling and feel free to delete it now, but I must address the
topic of dancing at the Symphony. I didn't see anything wrong with it. As
long as it wasn't during the Christmas song. I was one of the first to join
in on the dancing and as I looked up the Symphony started to smile. There was
energy in the crowd and I don't think anyone was going to stop it from
happening. There were older couples behind us, who were dressed up, that
didn't even hesitate to get up, they weren't yelling sit down, they joined
right in and I don't think it was unethical to do so. The screaming during
the Christmas song, well, that's a different story. Just venting some steam
and some excitement all at once, thanks again for listening...
Flannel or no flannel, I was there to have a good time, and I think everyone
else will agree with me. Peace.

Ft. Wayne tapers

Hey now,
I was wondering if anybody out there was planning on taping the
show in Ft. Wayne on 3/7, or if anyone knows anyone who will be
taping. I'd like to set up some sort of trade in advance rather
than bringing blanks and hoping I can find a taper. My ticket is
for the 12th row, and I would love to get someone down with me if
they'd want to tape from there. Hell, if someone wants to let me
borrow their deck and mics, I promise to take good care of them :-)
Well, anyways, I really want tapes of this show, and since most of
my DMB connection is on the east coast, I have to resort to these
kinds of measures. Please email me if you can help. I have over
300 hours of live stuff to trade, mostly Dead, some DMB and Phish.
